Terms and Conditions

Welcome to OC Health Clubs. These are the main terms to help you understand and get the most from your membership.

Key membership terms

These Key Terms and the General Terms below form your agreement with OC Health Clubs Limited, trading as OC Health Clubs (OC, we or us). Your Membership Details state your membership, price, start date, included services and any minimum term. They control if those details differ from this document.

Minimum terms

The fixed-term Group membership has a 12-month minimum term. Flexi Group has no minimum term. Personal Training has a minimum of 12 weekly debits.

After the minimum term

Your membership does not end or begin another fixed term. It continues week to week until you cancel by emailing [email protected]. The next two scheduled weekly debits are payable, at your current rate, and you retain access during those two weeks.

Ending early

Inside a minimum term, the early cancellation fee is 50% of the remaining membership fees, or any lower amount required by law. Once it and any overdue fees are paid, membership ends without two further debits. The fee is waived for death or documented permanent medical incapacity. OC may reduce it for serious hardship or relocation.

Freezes

Apply through OC's online freeze form at least seven days before the start date. A freeze is two to 12 weeks, costs $5 per week and extends the minimum term. You may have no more than two freezes totalling 12 weeks in any rolling 12 months.

Personal Training freezes use complete seven-day blocks. OC waives the fee for documented medical incapacity or injury, pregnancy, bereavement or temporary work relocation. Freezes are not backdated and you cannot use the membership while frozen. Cancelling during a freeze ends it and starts the normal cancellation process.

Payments and prices

Fees are paid weekly in advance and include GST. OC adds no card, transaction, administration or failed-payment fee. Your price will not increase during a minimum term. Otherwise, OC may change it on 30 days' written notice. If you cancel during that notice, the two final debits remain at the existing price.

Bookings

A $10 commitment fee applies only to weekday 5:45am and 6:45am Group Classes cancelled within eight hours or missed.

For Personal Training, cancelling more than eight hours before a session lets you rebook it within 14 days; cancelling later or not attending forfeits it. OC may restore a session for a genuine emergency at its discretion; it then expires after 14 days.

Access

Memberships include only the coached sessions and classes in your Membership Details. They never include independent gym-floor access.

Your rights

Nothing here removes a right or remedy that New Zealand law does not allow OC to exclude.

General Terms

1. Membership and access

You accept this agreement by signing or electronically accepting it, or by buying a membership that clearly refers to it. Memberships are personal and cannot be transferred or shared.

A Group membership covers its included Group Classes. Base Personal Training is coached in groups of up to four, with sessions of about 45 minutes, and includes the weekly session allowance in your Membership Details plus Pilates, Yoga and Mobility. It excludes HYPER, METCON, HYBRID and other Group Classes unless you add Full Group access. The add-on has no separate minimum term and can be removed after two further weekly debits. Removing it does not change the base membership.

OC does not guarantee a particular coach, training partner or recurring booking time.

Adult memberships are for ages 18 and over. A 16 or 17-year-old needs parent or guardian acceptance. Under-16s may attend only an OC programme designed and supervised for their age under a separate youth agreement.

2. Payments, bookings and changes

You authorise OC and its payment provider to charge agreed membership fees, add-ons and any valid commitment fee. Keep your payment and contact details current. If payment fails, OC may retry it and suspend bookings or access until overdue amounts are paid.

Bookings depend on the timetable and available places. Personal Training sessions expire at the end of the week issued unless the 14-day rebooking rule applies. If OC cancels a session or class and you lose paid access, it will provide a reasonable replacement, credit or extension.

Outside a minimum term, upgrades and downgrades take effect after two scheduled weekly debits unless OC agrees otherwise. A downgrade during a minimum term requires OC's written agreement. Full Group access follows section 1.

3. Cancellation

Written notice takes effect when OC receives it. Cancelling a bank authority does not cancel your membership. You may give notice before a minimum term ends, but two scheduled debits must occur before the membership finishes.

For permanent medical incapacity, OC may request confirmation from a registered doctor, physiotherapist or midwife, but not an unnecessary diagnosis. If the member dies, cancellation is immediate. In either case there are no final debits or early cancellation fee, and prepaid unused time is refunded proportionately.

4. Timetables, closures and coaches

OC may reasonably change coaches, programming, class names, equipment and timetables. It may run a reduced public-holiday timetable and close for short planned periods, including holidays, maintenance or staff training, with reasonable notice where practicable. These changes do not create an automatic credit unless they materially reduce the overall paid service.

If a prolonged interruption or material change to the location or core service significantly disadvantages you, OC will provide a reasonable alternative, credit, extension or payment adjustment. You may cancel without an early cancellation fee if OC cannot reasonably restore the core service.

5. Health, safety and property

Tell OC about relevant injuries, health conditions, pregnancy or symptoms, follow safety instructions, train within your capacity and stop if you feel unwell. Do not attend with a contagious illness. Obtain medical advice when appropriate.

Exercise carries ordinary risks. OC permits barefoot training where appropriate. If you choose it, you accept its ordinary risks and must follow instructions; OC may require footwear. Nothing here removes OC's duty to provide services with reasonable care and skill or maintain a reasonably safe environment.

OC may contact emergency services or your emergency contact where reasonably necessary. You are responsible for third-party medical charges. OC is not responsible for property loss it did not cause or contribute to. You must pay the reasonable cost of damage you deliberately or negligently cause.

6. Conduct and ending access

Treat people respectfully and follow reasonable safety, hygiene, booking and behaviour rules. OC may suspend access while investigating serious misconduct, unsafe conduct or unpaid fees. It may end membership immediately for a serious breach, or after warning for a repeated or remediable breach.

If OC ends membership without your breach, no early cancellation fee applies and prepaid unused time is refunded. If it ends membership for your breach, you remain liable for overdue amounts and any further lawful, reasonable loss.

Services bought directly from an independent provider are supplied under your agreement with that provider. This does not exclude OC's responsibility for its own conduct.

7. Changes, notices and complaints

OC may make reasonable changes for legal, safety, technology or operational reasons. It will normally give 60 days' written notice of a material change that disadvantages you, except for a price change covered above. During a minimum term, you may reject such a change and cancel before it starts without an early cancellation fee. Urgent legal or safety changes may start sooner.

OC may send notices to the latest email address on your account. A new website version does not by itself replace terms an existing member accepted. This agreement is governed by New Zealand law; if one term is unenforceable, the rest remains in effect.

These Membership Terms apply to memberships accepted on or after 1 September 2026. Earlier accepted terms continue unless validly changed or replaced.

Privacy Policy

This policy applies to members, programme participants, prospective members and website users. OC Health Clubs Limited, Shop D1-01, 19 Grant Road, QT Central Shopping Centre, Frankton, Queenstown 9300, is responsible for your personal information. Contact its Privacy Officer at [email protected]

What we collect and why

OC may collect your contact, identity, membership, payment, booking, attendance, communications, emergency-contact, exercise, health and progress information, account photographs, and website or device data. We use it to respond to you, recommend and deliver services, coach safely, manage accounts, payments and bookings, communicate with you, improve OC, handle incidents or complaints and meet legal duties.

We usually collect information from you, including through forms, contracts, consultations, coaching, our website and membership systems. We may receive it from a parent or guardian, your authorised health professional or emergency contact, OC staff, service providers or lawful public sources. Where required, we will tell you about indirect collection.

Providing information is normally voluntary, but OC may be unable to safely provide or administer a service without information it reasonably needs.

Use and sharing

OC may share information only as reasonably needed with its staff and coaches; membership, booking, payment, communications, assessment, hosting and IT providers; professional advisers, insurers and debt-recovery providers; emergency contacts, health professionals or emergency services; and regulators or courts. Some providers process information overseas. OC will use the safeguards or authorisation required by New Zealand privacy law. OC does not sell personal information.

Payment providers handle full bank or card details. OC usually receives only payment status, transaction information and a secure token.

Marketing and promotional use of an identifiable photograph, video, testimonial or result require any separate permission required by law. You can unsubscribe from marketing without stopping essential membership, payment, booking or safety messages. You may withdraw media permission for future use.

The website may use cookies or analytics to operate forms, remember preferences, measure advertising and improve the site. Browser settings can restrict them.

Security, retention and your rights

OC takes reasonable steps to protect information and keeps it only as long as reasonably needed for its purpose, an ongoing relationship, a dispute or legal and accounting obligations. It is then deleted, destroyed or anonymised where practicable.

You may ask the Privacy Officer to access or correct your information. OC may verify your identity and will respond under the Privacy Act 2020. You may also complain to the Office of the Privacy Commissioner. OC will notify affected people and the Commissioner of a privacy breach where required by law.

OC may update this policy when its practices or legal duties change. It will publish the current policy and give reasonable notice of a material change.
